You hereby agree to the following terms and conditions when placing an order for any joint distribution with City Flyers, LLC.
AUDIT. City Flyers, LLC agrees to maintain all documents, records of delivery, inventory control records, and all other reports pertaining to this distribution, making these documents available for inspection upon your request.
USE OF INDEPENDENT CONTRACTORS. You agree that City Flyers, LLC may use independent contractors to complete any required work.
ALTERATION OF DISTRIBUTION DATES AND TIMES. You agree that City Flyers, LLC reserves the right to change or alter distribution dates and times for any reason including weather related problems. This includes future predictions by the National Weather Service.
NO CANCELLATION OR REFUNDS. You agree that no amount of any credit or debit card payment issued to City Flyers, LLC will be refunded for any reason.
NO GUARANTEE OF RESPONSE. You agree that City Flyers, LLC does not expressly nor impliedly guarantees any marketing response from any distribution.
INDEMNIFICATION AND HOLD HARMLESS PROVISION. You agree hereby to indemnify and hold harmless City Flyers, LLC from any and all claims by you which may arise out of and in the course of the performance of its duties hereunder.
QUANTITY. You understand that each commercial joint distribution will consist of approximately 2,000 8.5" 11" flyers distributed over a 4 week period and each residential, door to door joint distribution will consist of approximately 5,000 8.5" x 11" flyers distribued over a 4 week period. You also understand that City Flyers will distributed up 40 hours worth of distribution hours for any joint distribution.
